Which one of us can claim buying a house on next years taxes me or my husband?

Buying a house in 2022

Hi.  Since you are married if you prepare your tax return married filing jointly the entire deduction would be on the joint tax return.

 

If you prepare your tax return married filing separately AND if the the house and tax documents are in both of your names and social security numbers you can decide who would claim the deductions.  You can not claim more than 100% of the total deduction.

 

If the house is only in one of your names and you prepare your taxes married filing separately that person should claim the mortgage interest, real estate taxes and other deductions.
