Being Claimed as a dependent by my mother(need help)

So my mother is refusing to file her taxes unless she has my W-2, she is trying to claim me as her dependent but I haven't lived with her since May of 2020 and I already filed for my 2020 taxes. What should be my next step if she was to claim me on her taxes?

If you already filed and you did not file as a dependent, no one else will be able to claim you and e-file. 

Another taxpayer COULD claim you as a dependent on their tax return, but they would be forced to print and paper-file their return. Eventually the IRS would contact you both, and make a determination of who filed correctly. 

 

For you to be her dependent, you would need to meet these requirements. 

If you don't, she can't claim you.

  • "Are they related to you? The child can be your son, daughter, stepchild, eligible foster child, brother, sister, half brother, half sister, stepbrother, stepsister, adopted child or an offspring of any of them.
  • Do they meet the age requirement? Your child must be under age 19 or, if a full-time student, under age 24. There is no age limit if your child is permanently and totally disabled.
  • Do they live with you? Your child must live with you for more than half the year, but several exceptions apply.
  • Do you financially support them? Your child may have a job, but that job cannot provide more than half of her support.
  • Are you the only person claiming them? This requirement commonly applies to children of divorced parents. Here you must use the “tie breaker rules,” which are found in IRS Publication 501. These rules establish income, parentage and residency requirements for claiming a child"

Being Claimed as a dependent by my mother(need help)

Since IRS doesn't open until Feb 12, both can e-File and whichever one the IRS grabs first will be the winner.

The other return will be REJECTED.
