Adoption Tax Credit Complicated Question

Complicated situation that we need an answer for.

 

We started our adoption journey in 2022. We incurred $10,800 in qualified expenses for an failed adoption. We claimed the $10,800 on our 2023 taxes (the max allowable that year was $15,950). Our income was too high to get the entire amount back. We got a reduced $7950 back instead of the entire $10,800. 

 

We took placement and a finalized an adoption in 2024. We spent around $20,000 in qualified expenses in 2024. 

 

Here are the questions. 

1. Are we able to claim a portion of our 2024 expenses since we did not reach the maximum when we filed in 2023?

2. If yes, how much can we claim? Do we use the $10,800 or the $7950? Also, would we use the 2023 max amount ($15,950) or  the 2024 max ($16,810)?

Adoption Tax Credit Complicated Question

You can you use up to the maximum credit for the 2024 adoption. The limit is per child

 

For the 2024 credit, you can claim up to the full $16,810 credit assuming there are no other limitations.
