We (unmarried) bought a home, only one is on the mortgage, both are on the title. Costs split 50/50

My partner and I purchased a home in 2020. She is the only person listed on the mortgage but we are both on the title. This is our primary residence and we split the cost and we each pay half of the mortgage and expenses. How do we file taxes to claim mortgage interest and property taxes?

You can only claim the expenses if you are legally liable. If she is the only person on the mortgage, she is the only one who can claim the mortgage interest deduction. However, if you are partially liable for property taxes as listed on the title, you can split the deduction in any manner chosen (0%/100%, 50%/50%), as long as the total between both returns does not exceed 100% of the expense.
