Tax amendment or not

I had gotten a 2023 W-2 for a class-action settlement in March 2023. I then mistakenly filed it with my 2022 tax returns. The Federal return went through just fine and I paid taxes that were due. The state owed me a refund but they said they did not have a record of the state tax paid in that particular W-2. So I got a refund after the state tax in that W-2 was deducted. This was when I realized the mistake I made. The question now is that do I need to file that W-2 again with my 2023 taxes and file an amendment for 2022? Or would I be ok to leave things as is?

If you received a W-2 in March of 2023, when was the settlement paid?

  • I don't think 1 2023 W-2 was available in March of 2023.  
  • Only the 2022 was available.
  • Check the filing year on the W-2.

If The settlement  was paid in 2022, you have filled everything correctly.

  • If you had any federal taxes withheld, the IRS would have noticed a discrepancy.

If you confirm it was paid in 2023, and the W-2 is for 2023 income.

You will have to Amend the 2022 tax return, and include it on your 2023 tax return.

 

If you want to make changes to a tax return that has already been submitted  and was accepted, you should follow these guidelines to amend your return.

  • You must first wait until the initial return is completely processed.
  • You will have to use the same TurboTax account that you used for the original tax return.
  • Once you begin your amendment, you'll see your original return.
    • The refund calculator will start new at $0 and only reflect the changes in the refund or tax due
    • Only make changes to the areas of your return that need amending.
  • You have three years from the date you filed your return or two years after you paid the tax due (whichever is later) to file an amendment

Sign in to TurboTax

  1. On the home screen, scroll down to Your tax returns & documents and
  2. select the year you want to amend
  3. Select Amend (change) return, then
  4. Amend using TurboTax Online
    1. If you're told to amend your return via TurboTax Desktop, follow the steps for TurboTax CD/Download below instead.
  5. On the screen OK, let's get a kickstart on your amended return, select the reason(s) you're amending and Continue.
  6. When you reach Here's the info for your amended federal return, select Start next to the info you need to change.
  7. Continue through the screens, make the changes you need to make, and carefully answer the remaining questions to finish amending your return.

The settlement was paid in Jan 2023. They sent a 2023 W-2(with Fed, state, SS and medicare withholding) for part of the settlement and a 2023 1099-MISC for the rest of the settlement. At the end I owed taxes and IRS took the amount without question. The State however owed me a refund and sent me a notice that they have no record of the state withholding shown in this W-2 and gave me a refund minus the amount that was withheld in this W-2.

Tax amendment or not

Yes, getting forms for 2023 while filing 2022 caused the confusion. You should amend your 2022 federal. The IRS will always take extra money, they only ask questions if they don't get enough filed. You do want to file this on your 2023 return. The IRS is running 3-4 years behind the current year for audits.
