My daughter used my insurance/HSA to have a baby but is not my dependent any longer- can we claim the portion that we paid out of HSA and our pockets?

When she got pregnant, she moved out in beginning of 2017- however, she was still on our insurance and we paid for several appointments with both HSA and out of pocket.  I have the receipts, cancelled checks, and credit card statements, as well as insurance claims.

Your daughter would need to be your dependent or could be claimed as your dependent (see below for rules) in order for you to take the distributions.

You can take distributions from your HSA to pay for qualified medical expenses for:

  • Yourself, your spouse, your dependents that you claim on your return, any person you could have claimed as a dependent on your return except that:
  • The person filed a joint return,
  • The person had gross income of $4,050 or more, or
  • You, or your spouse if filing jointly, could be claimed as a dependent on someone else's 2016 return.

If you also made additional out of pocket medical expenditures outside of the HSA and while she was your dependent then you can list those as medical expenses on schedule A for amounts that were not distributed through your HSA.

To enter a 1099-SA in TurboTax:

  • In your open return, select Tax Tools
  • Tools
  • Topic Search
  • Type 1099-SA in the box then select GO

Your daughter would need to be your dependent or could be claimed as your dependent (see below for rules) in order for you to take the distributions.
