I am married and filing jointly. My wife does not work and me, my wife and son live together in same house. My 3 year old son is going to day care. Can I claim credit for this day care expense?

The credit for child and dependent care requires both spouses to be working; since your wife does not work you are not eligible for the credit. The credit was intended to help out families who must pay for care so the parents can work.
