Do I need to issue 1099 for grandparent babysitting grandchild

Hi. I paid my parents for babysitting my kids. I'm not married and my kids are under 13. My parents are divorced and retired.  I paid my dad ~$2000 in 2023, and~ $5000 to my mom. Part of the payment was disbursed from my dependent FSA account and the rest was cash. 

1. Do I need to issue W2 to my mom as I paid her more than $1000 per quarter?

2. Do I need to issue 1099 to my dad?

There is no need to issue a 1099 or a W2.  This is because what you are paying them is a personal expense. You will need to have their name, address and social security number, and just add what you paid then under the Child and Dependent Care Credit.  They will have to report this income in their own tax return. 

 

To add the care in TurboTax:

  1. Sign in to TurboTax.
  2. Select either Edit or Pick up where you left off under Deductions and Credits.
  3. Select You and Your Family.
  4. Select Start/Review next to Child and Other Dependent Tax Credits.
  5. Answer the questions to complete the section.
