Possibly, it depends on fulfilling requirements which are listed below.

You can claim:

  • A child is under age of 13 when the care is provided, and whom you can claim on your return.
  • Your spouse who is unable to care for himself or herself and has lived with you in your home for at least half the year.
  • Any other person who you claim as a dependent who cannot take care of himself or herself and has lived in your home for at least half the year.

Those who provide care cannot be:

  • Your spouse
  • A parent of the child being cared for, including an ex-spouse.
  • Anyone listed as a dependent on your return.
  • Your own children age 18 or younger, regardless of whether he or she is a dependent on your return

Other requirements to meet:

  • You (and your spouse, if married and filing jointly) must have earned income.
  • The care paid for enabled you to work or look for work.
  • If married, file a joint return.
  • Information regarding the person providing the care including, name, address, Taxpayer Identification Number (TIN) of the person providing care.  The TIN can be either the  Social Security number, or an Employee Identification Number (EIN).

The maximum credit allowed is 35% of $3,000 for one person, or up to $6,000 for 2 or more qualifying persons.
