Can my husband use his HSA to pay my medical bills that were from before we got married?

I'm getting married in October of 2024 but am about to incur a few thousand in medical bills in August of 2024. They are putting it on a payment plan which will extend into 2025, will my future husband be able to make the payments on these pre-existing medical bills from his HSA account after we are married in October?

Yes, but...

 

Either the procedure must be incurred or the payment must be made after the marriage.  But in this case, payment means paying the provider.  That means that if you pay for the procedure in August with a credit card, your spouse can't use the HSA, because the provider was paid before the marriage.  If you are on a payment plan with the provider, your spouse can use the HSA for payments made after the marriage, but can't use the HSA to cover any payments that you might make before the marriage.

You can include medical expenses you paid for your spouse. To include these expenses, you must have been married either at the time your spouse received the medical services or at the time you paid the medical expenses.

Example 1.

Your spouse received medical treatment before you were married. You paid for the treatment after getting married. You can include these expenses in figuring your medical expense deduction even if you and your spouse file separate returns.
