Can a trustee (listed in our trust) living in my 'second home' deduct property taxes he/she paid for during the year?

my son lives in our second home which was a rental. since property tax deductions are limited to 10K, we no longer benefit from the 'write off".  the home is title in our trust and he is a documented member. can he deduct the property taxes he pays and what documentation is needed for declaration (if any)?

If the trust is a grantor trust (which it appears to be), then the grantor is (or are if the grantors are you and your spouse) considered to be the owner of the trust corpus (assets).

 

As such, if you son is not a grantor (i.e., owner), then your son cannot deduct the property taxes paid for the home as the tax is not imposed on him.
