New Jersey: NJ-1040-ES GIT/REP-1

Hello,

I am hoping someone can help me with a tax situation for my 88-year-old mother-in-law. 

 

A little backstory so you get the picture. 

 

She lived in New Jersey for more than 50 years with her now ex-husband. They had owned a home together since 1962. In 2016 after a physical altercation, she decided that she had had enough and moved in with her son in Arizona. She filed for divorce after waiting for the required waiting period to become a resident in Arizona. The divorce was finalized by default in November 2017, BUT, the court in Maricopa County crossed out anything regarding the division of property due to a lawyer screw up (that was then covered up by the lawyer - long story). 

 

Due to that court paperwork issue, she was bounced around like a ping pong ball between attorney's in AZ and NJ because no one knew how to fix it. She finally found an attorney in AZ that could fix it. The end of the story is that the home was finally sold and she received her share of the money in December 2022. 

 

Because she could not state that she was a resident of NJ at the time of sale, her NJ attorney handling the sale said the titling agency has to withhold a non-resident tax in the amount of $4,500 (2% of her share) but that she will get it all back once she files a New Jersey tax return. 

 

She had to fill out a NJ-1040-ES GIT/REP-1 form. 

 

She is not required to file a Federal tax return due to her income (only Social Security and this sale) - Turbotax already said a return is not required.

 

I paid for and downloaded the New Jersey software and it sucked in from her main return that she lives in AZ and is a non-resident. I went through the interview and none of the screens asked about this form. 

 

I emailed the NJ tax department about 2 weeks ago and never heard back. When I called in, it said no agents were available and to call at another time.  

Does anyone know what I need to do to get her $4,500 back?

 

Any help would be greatly appreciated.

Enter the amount as State estimated Tax paid on the Federal screen and carry it over to the NJ return. 

 

Deductions & Credits

Estimates and Other Taxes paid 

Estimates

State Estimated Taxes for 2022

Yes

Select New Jersey from the drop-down and enter 4500

 

NJ-1040-ES GIT/REP-1 reports estimated tax withheld
