Multi member Georgia LLC do we need to fill Penn return if our business is in PENN?

We own rental property in PA but are a Georgia LLC so do I need to fill PA return?

Multi member Georgia LLC do we need to fill Penn return if our business is in PENN?

There are most likely a number of items that need to be addressed here:

  1. You may want to register to do business in PA.  The reason for this is if you are not registered to do business and you have a legal matter that requires the PA court system you may not be able to file a claim.  You should seek legal counsel on this matter.  Here is a link that provides information on the registration.  Don't misunderstand the word "foreign" as meaning only a foreign county.  This means an entity not domiciled in PA.  https://www.filingsmadeeasy.com/pennsylvania/llc/foreign-qualification/
  2. Yes you should be filing a form PA-65.  In addition, there may be nonresident member / partner withholding requirements.  Here is a link to provide some additional information https://www.revenue.pa.gov/GeneralTaxInformation/Tax%20Types%20and%20Information/Partnerships-S-Corp...
  3. You should consider seeking some professional assistance on this to make sure you get going down the right tax filing path.
