It is your responsibility to file the form with your employer. That said, many employers let the employees know when onboarding.
You are not required to pay MD tax and can use your method. See Credit for Taxes Paid to Another State.
MD will give a full refund of the tax paid and VA will tax it all. Not knowing the penalty amount, you can get around it by filing a MD return and paying tax then taking a credit against VA. This should yield a better result. You would have to claim the MD income to be taxed by MD.
If you don't want to be taxed by MD, simply state that you were a nonresident living in VA and fall under the rules for their reciprocity agreement claiming zero MD income.
No statement is necessary either way. Your w2 shows the MD income if you decide to claim it. It shows your VA address if you decide not to claim it. You can efile whichever way you decide to go.
