Credit to other jurisdictions

From 1/1/23 to 6/30/23, both me and my spouse lived in NJ and work in NY. Normally, we would calculate income tax in NY and do the NJ-COJ to get credited on NJ tax. However, from 7/1/23 to 12/31/23 we movex to NYC. My spouse lives and works in NYC and I live in NYC but work in NJ. Normally, I would assume NJ would take tax in NJ income and it would be credited to NY and NYC tax, but how can you do credit to both states? Is there something that cancels out credits? Our earned income for NJ is different than NY and different than NYC.

Credit to other jurisdictions

Many states have agreements with neighbors, not NJ and NY. For the first 6 months, you have a NJ part year resident return.  You will claim NY credit for this 6 months. You must also file a NJ1040NR for the remaining 6 months. See  Forms and Instructions. NJ is one of very few states that wants 2 returns. 

 

For NY, you file only the part- year return. See instructions. You will claim the NJ credit for this 6 months.
