I received a 1099-MISC and a W-2 form for the exact same payment (settlement for back wages). Do I need to enter both the 1099-MISC and the W-2 or just one or the other?

I received a 1099-MISC and a W-2 form for the exact same payment (settlement for back wages). Do I need to enter both the 1099-MISC and the W-2 or just one or the other?

If you received the exact same payment reported on both a W-2 and a 1099-Misc, you should still include both forms and then back out the wages for the 1099-Misc.  This will tell the IRS that you received the 1099-Misc but you should not have that income as it is duplicated. 

 

 You will need to enter the 1099-Misc income and then back it out as a negative number to offset the income that is not taxable.

 

To enter the 1099 Misc as non-self-employment income take the following steps:

  • Income
  • 1099-MIsc under Other Common Income
  • Enter the information from the 1099-MIsc
  • Continue through and say the work does NOT involve work that is like your main job
  • Select the years you received it
  • Say no, to did this involve an intent to earn money

Then you will take the following steps to remove the income:

  • Income
  • Less Common Income
  • Miscellaneous Income
  • Other Reportable Income
  • Answer Yes to Any Other Taxable Income
  • Enter the description such as 1099-Misc received for Income double reported
  • Enter the amount on the 1099-Misc as a negative number.
