Per a divorce decree I am to receive all of the Ex's pension upon his death. He was drawing his pension while alive so the question I have is that when I report for taxes is the pension seen as such or is it considered as RMD income for me?

If this is a pension, and your Ex was receiving a monthly income, there will not be a RMD.

Regardless, the entire amount is taxable.

If I misunderstood and it was an IRA distribution, you can take any amount out, but at a minimum it must be the RMD based on your Ex's birthdate.
