Nonresident rental loss

Do I need to file a nonresident tax return if my only source of income in the nonresident state is a rental property AND that rental operated at a loss? Do I just put 'zero' in the "rents" box?

Your VA source income is the net profit from the rental which is less than $0.

No return is required to be filed.

You must file an income tax return in Virginia if:
  • you are a resident of Virginia, part-year resident, or a nonresident, and 
  • you are required to file a federal income tax return, and
  • you have Virginia adjusted gross income equal to or greater than the amounts below: 
     
Filing Status Income Threshold Single or married filing separately $11,950 Married filing jointly $23,900

what state is the rental loss in?

Virginia. Correct. The only source of nonresident income for that state is a rental property.

Nonresident rental loss

I’m a non resident in Vermont.  Only income source in VT is the net loss from rental property.  I can’t find info on the VT tax Department website.  I would assume no filing as I have no income.  Am I correct?

Nonresident rental loss

VT requires a return when you receive any money from VT. So, even though you lost money on the rental, you still need to file a VT return due to the income. Click this link for more on VT.
