When should I file amend return for the current year?

Hi,

 

I have filed my 2020 tax return using TurboTax a few days ago, but I just realized that, as NonResident Alien, I should have used form1040NR, rather than form 1040 that I actually filed from TurboTax. 

 

From previous posts, I've basically seen how to file an amended federal return. I just have two questions about that:

1. Given my situation, when should I file my amended return for the current year? Can I just file the amended return right now, or should I wait until either IRS processed my refund, or notice me for an amendment?

2. What if it turns out that my amended return using 1040NR results in less refund, while the IRS processed my refund based on my original wrong form 1040? How should I return the extra refund? Is it supposed to be filed together with the amended return, or some separate filing after I get reply from IRS about my amendment?

When should I file amend return for the current year?

You should wait until the IRS accepts or rejects your return.  If the IRS rejects your return or changes it you will receive a letter with instructions.  At that time you should be sure to respond and submit your amended return.  The IRS will adjust your Taxable Amount on final acceptance of your Amended Return.

 

IRS Form 1040-X (amend your return) will be ready on March 25, 2021. Sign up for email notification and we'll let you know when the most current form is available.

When you're ready to amend, find your situation below and follow the instructions.

Thank you for quick reply. Turbotax messaged me that both IRS and the state have already accepted my return. What should I do based on this case?

When should I file amend return for the current year?

  1. First you need to file the 1040-NR.  You can do that through our partner company Sprintax.  You will not efile the 1040-NR. Do not efile the 1040-NR, you will print it in Step 4.
     
  2. Then manually prepare the 1040-X from the IRS 1040-X site. Fill in the name, SSN/ITIN on the front page and then leave everything blank except the explanation.
     
  3. For the explanation:  Filing 1040NR to replace a 1040  filed in error.
     
  4. Print out the 1040-NR and write on the top of it in RED ink and highlighted:  AMENDED
     
  5. Attach the 1040-NR to the 1040-X and mail it to the IRS at the address on the 1040-X.
