Our refund was $4954.00 but after I amended my return as an injured spouse ( my income was $92975 and my spouses was $15549), the refund went to $0. Why?

IRS will not give you a refund immediately for filing the Injured spouse form .
Do not AMEND.

Sign and send in the form by itself.

I did not amend. If I file a 8379, will I still get the lower tax bracket of filing jointly or will they change me to the married filing separately bracket which is higher.

You can only file Form 8379 if you file Joint.
Are you in a Community Property State?

We did file jointly but want to make sure they aren't going to calculate my portion as if we did file separately. We do not live in a community state.
