I see my refund was deposited. I was blocked out of my account by a fraudulent email. The owner of said email got my money. Who do I contact before I take legal action?

Someone else had access to my account and I didn't. I tried being patient and got nowhere when I verified my identity. I'm now having to move and uproot my 9 yr old. What can I do to get my money?
