spouse and I now run diner together after 29 years as sole proprietor with single schedule c running it my self, now filing as joint venture this year and turbo tax auto filled spouse schedule c business address as our home address . we have employees so have had ein all along. Is spouse supposed to use same ein on schedule c to qualify employee wages expense. is it correct to file 2 schedule c's with same address and ein to qualify for same business deduction? Turbo tax just noted to use a different description of biz , no clarification of using same ein number to be able to expense labor, any insight?

Yes, you report two Schedules C, one for each spouse. The business info, including EIN, should be the same. You must share the business' items for income, gain, loss, deduction, and credit. Self-Employment tax should be calculated on a separate Schedule SE for each spouse.
@PatriciaV You left us out to dry on the issue regarding the negative gross sales price. Care to come back and at least apologize for promising a fix on Friday and then not delivering?
