Hi hilda0928 - IND-516-01 happens when your SSN has already been claimed as a dependent on someone else's return. Do your parents claim you on their tax return? If so, on your return, you need to indicate that you were claimed by someone else. See this article for more information about how to fix this reject.

but how do we fix it?

Unfortunately, it won't be easy. 

  • If you know who the other person is that claimed you.  You can ask them to amend their return and take you off.  You will have to mail your return, but you then could claim yourself.
  • Or, you can decide not to claim yourself and then you can E-File the return.  Then you could negotiate with the person that claimed you to get the additional refund.
  • Or, If you don't know who it is, you can mail the tax return.  The IRS will then contact both parties and determine who is right.  This will probably take some time.

Do you qualify as a dependent of the person who claimed you?

 

If not, you will need to paper file your return if you have already been claimed because the IRS will continue to reject your attempts to e-file.

 

Then, if you know who claimed you as a dependent, ask them to amend their return and remove you as their dependent. 

 

Important: If you don't know who might have claimed you, it could be a case of tax-related identity theft.  In this case, I would also suggest you Complete IRS Form 14039, Identity Theft Affidavit and mail it along with your return.
