Hey jtwhiteoak5,

Thanks, for the question. You are wanting to know how long it will take for your refund, when filing with form 8379.

Here is the info that I found out about this:

"Please note that takes 11-14 weeks for the IRS to process joint returns with Form 8379; about 8 weeks if the form is filed by itself, after the joint return has been processed."

I hope this has answered your question.

Thanks, for being the best part of TurboTax.

What do you mean? Are you saying that box 1 has two dollar amounts, and box 3 has two distribution codes? If so, I assume that box 3 has a '1' and a '2'? Is there an amount in box 2?

Your HSA custodian may have combined two 1099-SAs into one: one being for a regular distribution (code '1') and the other being for earnings on a previously withdrawn HSA excess contribution (code '2').

If there is an amount in box 2, put it on the 1099-SA that has the distribution code of '2'.

But this is only a guess. I urge you to contact your HSA custodian and ask them why they sent you such an irregular 1099-SA.

How long total did it take for you to get yours back?

I received a letter from IRS that they reviewed information I provided and determined no action is necessary on my account. Does that mean I’m not going to get my injured spouse relief?

@vanny0914 - you are tagging onto a 4 year old question.  Only the IRS can answer your question - call them.

@Marshallnoel

According to the IRS, the normal processing times for injured spouse claims are:

  • If you file Form 8379 with a joint return electronically, the time needed to process it is about 11 weeks.
  • If you file Form 8379 with a joint return on paper, the time needed is about 14 weeks.
  • If you file Form 8379 by itself after a joint return has already been processed, the time needed is about 8 weeks.

In these days of COVID-19, those timeframes may not apply.
