If my former employer refuses to send my w2 what can I do?

If you have not received your W2 at this point, and have made an effort, you will need to use your paystubs to complete a substitute W2.

You will explain to the IRS that your (former) employer refused. As they are required to provide, "threaten" them with this before you file. It can come back to bite them if you file a substitute form and state that they wouldn't abide by your request. 

Go to:

  • Federal Taxes
  • Wages and Income
  • Wages and Salaries
  • Add W2
  • Do your best to complete a W2 as if you had one
  • After entering this W2 draftyou come to the screen "Do Any of these Uncommon Situations Apply?" 
  • check Substitute Form
  • You will complete the Form 4852 as best as you can.
Your return cannot be efiled with a Form 4852, so consider one last attempt.

Do you have a W2 from last year? You will be prompted to enter an EIN, which you can get from another year. You can also try googling it or asking ex-coworkers for their feedback..

You should first call, email and snail mail them to make sure they have your current address.  They have until January 31 to issue your 2019 W-2.

Por ley debe dárselo.  Usted tiene derecho de recibirlo.  Pero, si para ahora no ha recibido apoyo para conseguir el documento, puede rellenar una forma W-2 sustituto si tiene la información necesaria.  La Forma sustituto también se conoce como la Forma 4852.  

 

No es difícil rellenar la Forma si tiene el último talón de cheques de ese trabajo y además tiene un W-2 del año anterior.  Tendrá entonces el EIN del negocio, y las cantidades que fueron pagadas a usted en todas las casillas.  Una advertencia: la información en el último talón no tendrá la misma apariencia que el W-2 y es posible que falte información.  El IRS casi siempre revisa la exactitud de la Forma, lo cual demora el procesamiento.

 

Al mismo tiempo, puede conseguir una transcripción del IRS para usarla como Forma sustituta.  Lo único es que la transcripción no tendrá la información del Estado, y será necesario conseguir esa información para su declaración al Estado (si su estado tiene una declaración de impuestos).

 

Finalmente, también puede conseguir una copia de su W-2 de la Administración de Seguro Social.  La copia de SSA le costará $86 por el procesamiento.

If you cannot get a copy of your W-2 by February 14, then you may be able to file your return using a substitute W-2 but you will not be able to electronically file your return.  To do this, you would need have your final pay stub from December and file using the numbers on that final pay stub.

My former employer (Manager) is refusing to give me my W2. I quit my job on very bad terms with her. I asked my co-worker if he got his W2 and he said he got it by asking my other co-worker to give it to him. I then asked my other co-worker if he could give me my w2 but then he said that my Manager told him that I had to ask her for it. I blocked her number and I'm really not in the mood to ask her for it. Unfortunately, brain dead me decided to throw away all my paystubs so I can't even calculate my taxes from them. What do I do now?

This will contain the information from all the W-2s that were sent to the IRS by your employers. However, it does not include the state and local information (boxes 15 - 20). We have attempted for yrs to get a w2 for my deceased ex husband to do his final tax return as I am the one to file his tax returns because our children were minors. The employer I know and I have many paystubs but I believe he is refusing due to undereporting.

Options are :

1) get an income transcript

2) report him and use a substitute W-2 form  https://www.irs.gov/taxtopics/tc154

3) get one from SS if he ever filed one

2013 !!!   

 

If the IRS did not send a bill for the unpaid balance due on the unfiled return by now you are not going to get one and it is way too late to file for a refund ... so I would not even try to file this return any longer.

Why should I have to pay another company to receive a legally required document that any company is failing to provide?

 

The company failing to provide the W2 should be fined and a complaint should be filed with the IRS.

 

As an employee, I should NOT be charged AT ALL for information my employer is legally required to provide, and in a timely manner. 

Sending your customers to another site to be charged is irresponsible.

@jasondspencer There are no other posts from your username in the forum.   Your post lacks any context---we have no idea what document you are trying to obtain   (a W-2? ---   from what tax year?   )   or why you believe you are being charged to obtain it.   What are you trying to do?

Sorry if you don't like your options on how to get a copy of the W-2 form ... if the employer didn't send one then you CAN turn them in to the IRS for this failure and getting a copy off the income transcript is free.

 

Employers have until January 31 to mail out W-2s.

While you're waiting, here's some things you can do:

  • Ask your employer when they mailed out their W-2s.
  • Did your employer mail your W-2 to an old address? If so, ask them to re-send it to the new one.
  • See if you can import your W-2.

If you haven't received your W-2 by February 14, it's time to take action:

  1. Grab your last 2020 pay stub and call the IRS at 1-800-829-1040.
  2. The IRS will ask you for some info before following up with your employer.
  3. After notifying the IRS, you can either continue waiting for your W-2 or paper-file your return using Form 4852 and your last pay stub.

 

 

You can get a wage and income transcript from the IRS:  It will not show the actual W-2, 1099’s, etc, but will show the income information the IRS received.  It will not, however, show your state information. It will only show the federal information.

I was replying to the post stating if we dont receive a W2, we need to go to social security and be charged for a copy.

 

I was here reviewing posts for exactly this topic. I see everyone is combative and aggressive. awesome forum. not toxic at all.
