In order to claim tips, as a self-employed individual, you must have income reported to the IRS on a 1099-K, 1099-NEC or 1099-MISC.  The new law only applies to tips that are reported to the IRS.  If they are not reported to the IRS on a form other than your Schedule C, you cannot claim them.  

 

This means that if you enter your income as cash or checks and it was not reported on one of the forms to the IRS, you cannot take the deduction. 

 

Taxpayers may be able to claim a deduction for qualified tips paid to them in 2025 that are included on Form W-2, Form 1099-NEC, Form 1099-MISC, Form 1099-K, or reported directly by them on Form 4137.

 

If you did receive a 1099, that included tips, then you would need to enter it separately from the rest of your income to be able to take the No Tax on Tips deduction.

 

In order to claim tips, the following must apply:

  • The tips MUST be reported.  If they are not reported on a form to the IRS you cannot claim them for the no tax on tips deduction.
    • If employed they need to be reported on your W-2 or form 4137
    • If self-employed, they must be reported on a 1099.  If you received them as cash, they are not deductible. 
  • Your income must be below $150,000 if you are single or less than $300,000 if Married Filing Jointly.  Above these amounts, the deduction starts to fade out and is not available at all for those with income over $400,000 for single and $550,000 for Married Filing Jointly.
  • You can not claim this deduction if you are Married Filing Separately
  • You receive tips from an occupation that normally and customarily receives tips
  • Self-employed, deduction may not exceed individual’s net income, without regard to this deduction, from the trade or business in which the tips were earned.

I feel that it is incorrect as there is a line on Schedule 1-A for tips to self employed not reported elsewhere and the IRS information states that in qualifying jobs these tips do qualify. So is it just TurboTax software won’t support entering g my information correctly on Scedule 1-A? Because I can see exactly which line on the form it goes on.

If your job does qualify, and your business received a 1099-NEC, or a 1099-K from a third-party settlement organization, even if the company did not separate the tips, you can claim the tips you received.  To do this you would have to keep logs that show the date, the customer, and tip received.  

 

In your return, after you enter your forms, you will be asked if any of the income reported is from tips. When you answer "yes" you will be able to enter your tip income and will be asked some questions to see if it qualifies for a deduction.

will TT be updated to allow non 1099 tips?,when i click yes to is any of this income tips,it says that i can't deduct it at this time and  i should wait for an update.

No, you cannot claim tips without a form 1099 or other "informational" forms sent to the IRS. 

The requirement is found in IRC § 224(a), which defines "Qualified Tips" eligible for the deduction. It states that a deduction is allowed only for tips that:
 
"...are included on statements furnished to the individual pursuant to section 6041(d)(3), section 6041A(e)(3), section 6050W(f)(2), or section 6051(a)(18)." Without describing each of these sections in detail,, these pertain to forms such as 1099 NEC, 1099 K, 1099 MISC, or a W2.

 

The reason for this is that only a third party can report "tips".  If you claim that some of your income is tips, there is no way to verify this on your word alone. It makes sense when you think about it.

The answer is no.  Tips are not eligible to be deducted unless they are included in your box 1 W-2 wages or box 1 of 1099-NEC.  That is a requirement of the law, and if you are seeing something else online it is wrong.

 

As a practical matter, you can never deduct anything from your income if it is not reported in your income in the first place.  If you have tips not in box 1, they are not included in your income.  You would be expected to self-declare them as extra business income not reported on a 1099.  (Do you self-report 100% of your tips every year?)  

 

Again, as a practical matter, you could get the same effect by simply not self-disclosing the unreported tips.  But this is not tax advice.

As i previously stated,when, i click on the box that asks if tips are included in the wages i reported,it gives a message that says that they are not allowed at this time and to check back for updates to TT.My question is ,will TT be updated to reflect this for this year tax filing season?

Can you post a link to where it says that?  You can definitely never deduct anything that is not included in income to start with, so you would have to declare the tips as income before you could deduct them.  But the regulation is pretty straightforward.  You would have to report the tips on form 4137, but I don't think you can access that form in Turbotax unless you have a W-2.  I have already asked for a review.  You should see if you can report your tips on form 4137.

The proposed regulations would clarify that the term “qualified tips” for employees participating in the TRDA or GITCA program includes tips reported using the tip rates established under their agreement and additional tips reported on Form 4137."

Section 224(a) of the tax code defines "qualified tips" only as those that have been reported on the income reporting forms mentioned above.  That means that, by law, tips that are not reported on one of these forms are not permitted to be excluded from taxable income.

Honestly,if you google can i deduct tips without a 1099,AI states that the IRS says that you can as long as you keep detailed records,however i have searched on the IRS.gov site and cannot see that stated.Either AI search is incorrect or it is there somewhere.

So basically all uber drivers like me who made less than 20k and are not issued official 1099 for tips are all excluded from deducting tips?I made over 10k of my total income in tips last year and according to you all on this thread im **bleep** outta luck?

Dave,i am using TT self employed,when i check the box that says is any of your income from tips yes,it states that i cannot take the deduction at this time but to check back for an update,so basically it will not allow the deduction.
