I accidentally hit "file my return"... I need to remove the W-2 and file (not amend) electronically as per New York State law.

So, here is the story... I have been trying to file for months now... I accidentally went all the way, and TurboTax won't allow me to file electronically with a W-2 that lacks a value in Box 1... I contacted the IRS, and they stated that I don't need to record the extra W-2, but unfortunately, I seem to have locked myself out of filing completely, as NYS law requires that all software based tax prepared tax forms be sent electronically... Thus, I need to simply go into TurboTax, remove the W-2, and file the first time electronically before Tax Day...

And by the way, I have not yet printed my original returns and sent them, as NYS will not accept a paper return... It is only my third time filing taxes, and I really just want to fix it and send it immediately...

In past years, yes... This year, I got stuck with a W-2 that I thought had to be reported... As I stated, I contacted the IRS about it, and it turns out to be a valid, but unnecessary W-2... I have not printed my returns, nor sent them in any form for this year...

TurboTax insists I must file on paper, but I know after contacting the IRS that this is not the case, and my only option (according to TurboTax) is to file a 1040X...

If you hit File my Return then it probably got sent by efile.  You better double check if it went though,

You can mail your NY return - see below.   When you sign in, do you see 'Take me to my return'?

What I am saying is it claimed I filed already, but I haven't sent anything because NYS requires it be electronic... Amending requires mailing, and NYS already won't accept the original because it was prepared electronically and thus needs electronic submission...

All I need to do is remove a W-2 from an original file I haven't sent yet, not amend and mail something that won't be accepted anyway by the state!

Nope! It states simply "Printed", which I never did because of NYS filing requirements...

Here is your problem - If you did in fact e-file your federal, you cannot e-file your state until your federal is ''Accepted''.  If you have not e-filed your federal, you cannot e-file your state - but because of this (see the answer), you are NOT required to electronically file your state - you are exempt..

You ''filed'' by mail through TT, you will need to print and mail federal and state.  You are exempt from the NY e-filing requirement.

The IRS says you didn't file because they have not received your mailed-in return.  You chose ''by mail' instead of 'e-file' when you filed your federal.

Since TurboTax does not support e-filing for your return, you are exempt from the mandatory e-filing requirement.  You're required to electronically file your return only if you meet all three of the following conditions:

  • you use software to prepare your own personal income tax return;
  • your software supports the electronic filing of your return; and
  • you have broadband Internet access.

Since you don't meet condition #2, you can mail your return.  As of April of 2012, the New York Department of Taxation removed the formerly-imposed $25 penalty for filing by mail.

Here is the address and mailing instructions for New York state tax returns:

You must include the following on your envelope:

  • your return address
  • enough postage (some returns require additional postage)

If you are NOT including a payment, mail your return to:

STATE PROCESSING CENTER
PO BOX 61000
ALBANY NY 12261-0001

If you ARE including a payment (check or money order), mail your return (including Form IT-201-V) to:

STATE PROCESSING CENTER
PO BOX 15555
ALBANY NY 12212-5555

Include copies of any documents that report NY withholdings or NY earned income.
