What form do I use for incarcerated prisoners

1040 or a 1095

What are you trying to do?

 

A 1040 is a tax return.  A 1095 is reporting health care  insurance issued by a health insurance company.

The prisoner uses form 1040 like everyone else. Note that you cannot claim a prisoner as a dependent. The prisoner has to sign their own tax return.

The 1040 is the tax return you file.

A 1095 is a form you receive for your health ins.  You enter a 1095A into your 1040 tax return.

I am the POA for my nephew who is in a correctional institution and I'd like to file a 1040 for him.

Yes. As long as you are the Power of Attorney for your nephew and a current Form 2848 is filed, you are able to file his taxes without his review and signature. Please keep in mind that the POA must include the tax year 2020 if you are filing for him this year.
