Married - Do I qualify for HOH?

Thought I saw some things that lead me think I can but want to confirm if I can claim Head of Household if I’m married (and not have to do married filing separate)? My spouse & I are in the process of getting divorced and still considered legally married in our state but we did not live together at all in 2021. I got my own place with the kids and pay all housing costs on my own the entirety of the year as well.

Am I Head of Household?

If you qualify as Head of Household, when you enter your marital status (single or married filing separately) into MyInfo, and then enter your qualifying dependent, TurboTax will offer HOH as your filing status.

Yes, you qualify for head of household if you did not live with your spouse in 2021 and

  1. Paid more than half the cost to run your (or a qualifying parent's) home this year (rent, mortgage, utilities, etc.) and
  2. Supported a qualifying person (your kids).
