Can I file an amended 2021 1040-X with an 8379 if I mailed in the original after it was Rejected through TT?

I mistakenly went to HRBlock for my 2021 attempted to file my Fed. Return with an 8379.  IRS rejected it so I came back to TT. I paid my filing fee to TT then IRS rejected the filing.  I printed it & mailed it to IRS myself.  IRS sent a letter stating 8379 was missing (as well as the Recovery Refund amount.  IRS requested (by letter) an amended return be submitted with the income adjustment & the 8379.

I followed TT instructions to download my 2021 return, but it doesn't provide a fillable 1040X or auto-fill 8379.  please help.

Yes, you can amend your return and include the Injured Spouse Form. Below are the amending guidelines and the instructions for including Form 8379.

 

Form 8379 lets you (the "injured spouse") get back your portion of a jointly-filed refund if it's seized or offset to pay your spouse's debt. 

You must file jointly to use this form. Filing an 8379 will delay your federal refund by up to 14 weeks. 

To file this form in TurboTax: 

  1. Open or continue your return. 
  2. In the search box, enter injured spouse and then select the Jump to link in the search results. 
  3. Answer Yes to Do you want to claim innocent or injured spouse relief? and carefully follow the onscreen instructions. 

Note: Pay close attention to the screens, as some of them apply to innocent spouse relief, which is different. Leave those questions blank if you only want to claim injured spouse relief.

  • You must first wait until the initial return is completely processed. 
  • You will have to use the same TurboTax account that you used for the original tax return. 
  • Once you begin your amendment, you'll see your original return.  
  • The refund calculator will start new at $0 and only reflect the changes in the refund or tax due 
  • Only make changes to the areas of your return that need amending. 
  • You have three years from the date you filed your return or two years after you paid the tax due (whichever is later) to file an amendment
