Working From offshore

I'm on H1B - non immigrant work visa. 4 months of 2021, I did my work from India. During this time I was on US payroll.

- How does this affect my tax?

- Am I supposed to mention my offshore work while filling tax returns? How can I do that?

- Are there any tax agreements or policies between US and India regarding such situations?

Your H1B non-immigrant work visa does not affect your taxes.

  • You were in US for more than 183 days and you qualify to file as a resident, regular tax return.
  • You were on US payroll for those four months, and it is a US source of income even though you worked from India. All US sources of income is to be reported in the tax return.
  • There is no need to mention your working from India anywhere in the tax return.
  • There is no tax treaty between US and India on this subject.
