Why am I being required to file form 8615 and the Tax of Certain Children?

None of the requirements to fill out the 8615 form apply to me. Why am I being asked to fill it out?

Form 8615 is used to figure your child’s tax on unearned income. 

If you are not required to file this form follow the steps to delete it:

  1. Log in to your account.
  2. Go to Federal Taxes.
  3. Go to wages and income.
  4. Scroll down to Less Common Income .
  5. Scroll down to Child's Income (Under Age 24) and click revisit. 
  6. Answer No to the question "Any Child's Income?"

What if this IS being required to fill out and Turbo Tax keeps pushing back the date they'll give me the form

First, thank you for your original solution to OP's issue.  However, it did not eliminate Form 8615 for me.

I do not understand why Form 8615 is even invoked by Turbo Tax in my situation.  Single, 23-year old non-student that DOES NOT meet the filing requirements for Form 8615.  I should not have needed to go to the Child's Income (Under Age 24) section at all.  But I did follow your instructions and Form 8615 is still there.  It is causing an error--"Form 8615:  Filing status should be blank." and I cannot 'pass' my Federal Review.  I can't tell from the accompanying Form 8615 what is need to correct this.  There is no "Filling Status" on the form.

Check to see if in the "My Info" section you may have indicated you could be claimed as a dependent on someone else's return.  That may be triggering the form.

Thank you DMarkM1, but that was not the case.  I started a new return and watched more closely the status of forms required at each step.  I am coming to believe that the Form 8615 is being 'required' as a result of the Turbo Tax program importing last year's return information.  I will start a new clean return without importing last year's and see if the form is still 'required'.  Thanks again.

If you have a child and any of the following apply TurboTax will generate a Form 8615.

  • If your child is younger than age 19 or a full-time student age 19-23, he or she must file a tax return for 2019 if he or she had any of the following:
  • Unearned income (interest, dividends, capital gains, taxable scholarships, unemployment compensation) of more than $1,050.
  • Earned income (wages, salaries, tips, and fees) of more than $12,200.
  • Gross income (earned and unearned income) was more than the larger of:  $1,050 or earned income (up to $12,000) plus $350

Thank you LeonardS.  I understand the regulatory requirements; it was the Intuit processes I was not understanding.  The child did not meet any of the requirements you listed, and I could not rid myself of the Form 8615 error.  That is why I was asking.  Starting a clean filing, without importing last year's filing, did the trick.  Understand that Turbo Tax would NOT let me file originally until I fixed the form 8615.  But I was not able to fix it under the circumstances.  Therefore had to start a new, clean return.  Thanks.

I had the same issue and spent all morning on the phone on hold and looked up so many questions. Try this and see if it works. 

1. go back to your information

2. double-check all the questions

my issue was that one of the questions asked if I supported myself all through 2021. I selected no. 

GO BACK AND SELECT "YES". THAT WILL REMOVE THE FORM 8615 AND YOU WILL BE ABLE TO E-FILE.
