Who can file for an extension for deceased if no administrator has been appointed?

My father passed away before doing his taxes. I was going to file for an extension but my sister told me that I couldn't since an administrator has not been appointed. He died without a will. As far as I know he paid estimated taxes and is owed a refund. I am currently in control of his financial affairs. Should I worry about any penalties if I send in the extension?

I wouldn't worry about it. Just go ahead and file the extension.  There won't be any penalties.
