Where does my refund go if my husband owes but I do not. Does it get taken off to pay for him?

If your spouse owes back taxes or child support, you can file jointly and file form 8379 - Injured Spouse with your tax return. This will prevent the IRS from intercepting your share of the refund to pay your spouse's debt.
