What to do if Schedule K-3 from a company is not available until after the tax filing deadline.

I got my Schedule K-1 from a company and box 16 is checked indicating Schedule K-3 is attached. In their cover letter the company says, in fact, Schedule K-3 will not be available until summer of 2022. Not really sure how to handle this. I'm most concerned there may be foreign tax paid for which I should be able to get a credit for. Does the fact there is a K-3 mean there was definitely foreign tax paid? I told TT  that box 16 was checked and they give me a message on review that I need to do the K-3, which by the way isn't available at TT as of now. My options include telling TT the box isn't checked, filing for for an extension until the K-3 is available or filing w/o the K-3 and amending later on. Any advice would be appreciated.

Based on your statement, you think you will get an additional refund after you include the K-3.  You have two alternatives.

  • You can file the tax return without the K-3, and then file an amended return when you receive it.  You have 3 years to file an amended return
  • You can pay any tax you owe prior to April 15th, 2022, and file for an extension.  This will give you up to October 15th, 2022 to file your return.
