What happens if I do not submit a 1095-a or 8962 form

A few things may happen: (1) The IRS can adjust your return based on that missing information, and if they determine taxes should have been due, they will asses penalties and interest on that amount, (2) They can reject your return for incomplete information, or (3) They will hold your refund and request you send in that information.

You can only amend a return after the original has been accepted and the money is settled. Last year, the IRS issued letters demanding forms before refunds could be released. If you have already filed, it is just a wait and see game.

 

If you do get your refund, you will want to do an amended return because the IRS has 3 years to audit you after filing and they will catch this. Please follow these steps for amending if you reach that point.

 

If you get a letter from the IRS and they are holding your refund: 

*you will go back into your return

*You will NOT amend.

*add the information on 1095a

*print and mail the 8962

So if I got the letter today I need to send in the two forms? The IRS page went from showing "accepted" to "still being processed" overnight. 

 

Also, do I round to the nearest dollar on every box on the 8962 paige? My tax credit all show down to the penny

If you don't submit the requested forms:

The IRS might :

  1. Reject your return for incomplete information..
  2. Hold your refund.
  3. Adjust your return and if they determine that you have an amount due they will assess penalties and interest.

I got my letter last Friday saying I didn’t fill it out. Faxed it Saturday and I haven’t heard anything yet. Still says processing on the site.

If you selected direct deposit and filled in the account information your refund will still be direct deposited following correspondence with the IRS.

TurboTax does not have any information regarding the processing time of a tax return or individual documents.  Based on this conversation it does look like there are a number of people involved.

 

I do not recommend FAXing documents unless you are talking to someone that can pick them up.  However, I will give you an alternative.  This link will help you find a local IRS office and then you can drop these documents off   Local IRS Offices .

My ex husband and I alternate years to claim our son.  2019 was my year and I completed my taxes thru turbo tax.  I just received a letter back stating that they needed more information from me regarding healthcare market place and form 8942.  My ex husband is supposed to be responsible for insurance.  I was not aware of the form that I needed to submit.  He is getting it for me.  How does this affect my taxes and my refund?  Wouldn't he be responsible for that on his taxes?

Normally, the recipient of a form 1095-A would complete form 8642 and attach it to their tax return. However, if you were covered on your spouse's insurance or you are claiming a child that is on the policy and is your dependent, you may have to enter your share of the health insurance premium data listed on his form 1095-A on your tax return.

 

You need to ask your spouse what percentage of the costs he claim on his tax return, as you will need to claim the rest if he claimed less than 100% of the insurance costs listed on his form 1095-A. He is only required to claim a percentage of the costs, but he can choose to claim 100% if he wants to.

this year my ex refund is in hold because irs is asking him for 1095 a for my son. I receive same letter for my other kids. I claimed our son too because im the one that has the form. The question is. If his refund is in hold will i get the credit for our son? .

No, you won't.

The credit is part of your refund and the IRS will hold all the refund.

I faxed mine. The number to call that deals directly with this situation (Affordable Care Act - IRS forms 1095 A and 8296) is 1-866-682-7451, extension 568. They will be able to help you with the fax number and advice as to what you need to do.

I filed mine through TurboTax. They offered little to no help.  I would recommend you doing the filing and faxing the paperwork. All in all it'll take three to four weeks for it to get resolved usually. They say "up to 6 weeks." Here's a very helpful link providing a step by step instruction on filling out the 8962 form.
