ACA penalties for not having health insurance are still in place for the current tax year - except for some exemptions that have been part of the law since it was enacted.
- The IRS is currently reviewing the executive order related to the Affordable Care Act but the law has not been repealed.
- While the House of Representatives recently voted to repeal and replace the ACA, the bill still must make it through several more steps in the legislative process before it becomes law.
- For now, the House’s recent vote has no effect on 2016 or 2017 tax law. If and when the ACA is replaced, TurboTax will be updated with the most current tax laws.
