Any forms I need to fill out? He isn't being forced by child support division to get them medical insurance even though its on the Child support agreement. I tried asking child support division to help and they have not done anything about this issue to help me. Non-cust parent asked me to apply for Medicaid instead but I do not qualify for this nor food stamps, house hold for 3 "I MAKE TOO MUCH MONEY" yeah right!! Sighhh...

Unfortunately, under the tax rules, it does not matter if the other parent is court ordered to provide health insurance for the child. If the child is not insured, the parent who claims the child on his/her taxes is will have to pay the penalty.
Did you apply for Medicaid and was denied? If so, you can send in your application for a Hardship exemption from Healthcare.gov. If you did not apply for Medicaid (and were denied), you probably won't receive the Hardship exemption.
