No, a person on Temporary Protected Status (TPS), is not a legal U.S. resident and may qualify to have the IRS penalty for going without health insurance in 2015 waived.

Answer the Health Insurance section in TurboTax as follows:

  1. answer "no" to "Did you have health insurance coverage in 2015?"
  2. select "Not a US citizen" to "Does anyone have a situation that waives the tax penalty for being uninsured?"
  3. answer the following on-screen questions to complete your Health Insurance section.

If you already filed and need to change your answers, then you will need to amend your tax return. Please note the earliest you can amend is February 11, 2016. But don't worry you have until April 18, 2019 to amend your 2015 taxes. See FAQ below for more info: https://ttlc.intuit.com/replies/3288565
