My husband died the first week in January 2016 can i file married filing jointly even if he had no income?
turbo tax says my income is too high to claim education expense for my dependents can they claim it in their own tax returns?

Yes, you qualify to file as married filing jointly. The IRS allows a taxpayer to file jointly with a non working spouse. The children will not be allowed to claim education expenses, since they are your dependents.
