Is nonemployee compensation received as a real estate agent considered qualified business income? Not sure if the IRS considers commissions as wages.

There are only two ways to report income from labor, as an employee or as an independent contractor.

If you received a Form W-2 then you are an employee. But, if you received a Form 1099-MISC with box 7 completed then you are considered an independent contractor. As a result your commission must be reported on the Form 1040 Schedule C or Schedule C-EZ as self employed income.

Generally, commissions are considered wages. But real estate agents are typically independent contractors and must pay their own taxes by making estimated tax payments.

You should check 'yes' to qualified business income.
