Is it a problem if my wife is listed as a DPINS on my w2?

I have been married for nearly 5 years, but my wife was still listed as a Domestic Partner by my employer.  Is there a tax penatly for this on the health care insurance?  I have a DPINS amount of over $7000 on my W2.

You have at least three questions.

 

I have been married for nearly 5 years, but my wife was still listed as a Domestic Partner by my employer.

  • Provided you filed your tax return as Married, or Married filing Separate.
  • It will not be a problem with the IRS, 
  • But it may be wise to change it with your employer.

 Is there a tax penalty for this on the health care insurance?

  • If you have Marketplace insurance you must be caesious.
  • The income is based on Household income.
  • If you're married that would be both of you.
  • If you did file together, you will know the result directly from the tax return.
