Is a resident alien without SSN(only ITIN) eligible for stimulus check?

If turbo tax keeps saying 'you are eligible for stimulus check', how can I fix it?

No. The IRS says you are generally eligible if you were a U.S. citizen or U.S. resident alien in 2021, you were not a dependent of another taxpayer, and you either have a valid SSN or claim a dependent who has a valid SSN or ATIN, you are eligible to claim the 2021 Recovery Rebate Credit.  

 

You may also be eligible if you file a joint return with your spouse, you or your spouse were a U.S. citizen or U.S. resident alien in 2021, and either you, your spouse, or both of you, have a valid SSN or you claim a dependent who has a valid SSN or ATIN.

 

Did you enter a dummy SSN? TurboTax does not let you proceed without an SSN. If you entered a dummy number, TurboTax may be assuming you are eligible.

 

You can remove the stimulus payment by telling TurboTax you got it (even if you did not).

 

  • Type stimulus in Search in the upper right
  • Click jump to stimulus
  • Say YES to It looks like you qualified for the stimulus, did you get any payments?
  • TurboTax will show you the check amounts you were supposed to get.
  • Say YES the amount is correct and TurboTax will not add any money to your refund.

Let me ask you one more time with more details. 

My husband is a resident alien with SSN and I'm a resident alien without SSN, but with ITIN.

We are using Turbo tax for Married Filing Jointly. 

 

Q1) If I understand correctly, my husband can have the 3rd stimulus check, but I can't. Am I correct?

Or can I have the 3rd stimulus check as well, because my spouse has a valid SSN and we are filing jointly?

 

Q2) In case that I'm not eligible for 3rd stimulus check:

To report Married Filing Jointly, I should put my ITIN on my personal information section-SSN part. While we process everything normally, I should answer (at the stimulus check part) 'My husband didn't get stimulus check, but I got the stimulus check.'. Even though I didn't get the stimulus check, by answering this, I can avoid getting stimulus check which I'm not eligible for. Am I correct?

For your first question, yes, you are correct.  Your husband is eligible for the 3rd stimulus payment but you are not.

 

Your second question, you need to answer the question about the stimulus checks truthfully.  If neither of you received payment that is how you answer.  TurboTax understands that with an ITIN you are not eligible for the Recovery Rebate Credit.
