If my husband and I filed joint federal taxes, but are filing separate state taxes, who can claim our children? We have different state residency.

He is not legally required to file state taxes due to his residency (and being in the military). I work and am a resident of NC. Can I claim our children as dependents for the tax credit? We filed jointly on our federal taxes.
