If my 17 year old son has to file a tax return to a refund, can I still claim him as a dependent on my return?

My son worked part-time this past year. The store he worked for took out taxes that we think he is due to get a refund for.  In order to get the refund for him, it is my understanding I need to submit a separate return for him.  If I do this, will I still be able to deduct as a dependent on my tax return?

If your dependent has a W-2 for his after-school job, etc. you do not include the information on your own return. You can still claim your child as a dependent on your own return.  He/she can file his own return for a refund of some of his withheld wages (he won’t get back anything for Social Security or Medicare), but MUST indicate on it that he can be claimed as a dependent on someone else’s return.  (Supervise this closely or prepare it for him!)

If your dependent’s earnings were over $400 and were reported on a 1099Misc then he must file a return and pay self-employment tax for Social Security and Medicare.

My daughter is studying on the college and did work part time for few weeks in 2017. She got W-2 form from her employer. Should she file tax return? She earned $55.00 in 2017

Fifty-five dollars?  Were any taxes withheld?  If not, she has no reason or requirement to file.

Thank you very much. I wasn't sure how this would work. He only worked 6 months in 2015 after school, & he was really hoping he would get a refund, but I wanted to make sure before I filed mine. Didn't want to mess anything up. Thanks again for your help.

If he is a full-time student under the age of 24 she can claim him.  If she claims him she uses the 1098T on her own tax return.  He can file his own return to seek a refund of tax withheld but must say he can be claimed as a dependent on someone else's tax return.
