I paid 3900 dollars in legal fees to become my brother's guardian and conservator. Why can't I deduct this?

That’s a personal not a business expense.

Because it most likely will fall under the category of personal issue. See this article for reference. 

In some cases, if the conservatorship was required for needed medical care, then a portion of those fees for that purpose could be potentially listed as medical expenses.
