I have just applied for my ITIN number, but I have to wait for it before submitting Indiana state tax return. I do not owe any tax due and I will get refund. Given that I will submit after the deadline, will it cause any problem or penalty?

Hi, I am a non-resident alien in Indiana. This is my first year in the US. I completed all my federal and state taxes and I have just applied for ITIN with submitting Federal taxes. However, I was told that before obtaining ITIN, I cannot submit my Indiana state tax return. I have to wait for 9-11 weeks. I do not owe any state taxes, actually I will get refund. Does this situation cause any further problem and penalty? Can I submit my state taxes in Indiana without ITIN?

By the way, I have also sent a Form 4868 before the deadline to apply for extension. But since I have not ITIN or SSN, the official at the local IRS office said that they cannot check if my application for extension has been approved or not. If you enlighten me about these issues, I would be very appreciated, because I am very anxious. Thank you.

@balatlinusret , assuming that this is real situation  ( and not a quiz question ), 

1. how did you end up earning monies without having an SSN -- ITIN does not allow you to earn / work in the USA ?

2. A non-resident alien reports income and deduction/credits on form 1040-NR ( which is not supported by TurboTax )  -- so how did you end-up filing with TurboTax ?

3. What is your visa status --- F-1, B, H1-B or what ?  When did you enter USA ?

4. Which country are you a citizen of ?  

 

While states mostly don't care about your immigration status, they heavily rely on IRS for a valid federal return for a starting point.  So I am very confused about your situation.  Please answer mt questions and I will circle back to help you -- yes?

Thank you for your return. Sorry for the confusion.  I am an international student with fellowship. So I have received stipend from the university and my taxes have been withdrawn by the university. I was told that I could apply for ITIN at the time of federal tax return. So I sent my tax return documents as well as ITIN application in a local IRS office at the same time. However, I have to wait for sending my state tax return until I receive ITIN. I do not owe any federal and tax payments. So, I have to wait for state return. Does it cause any problem?

Yes you need to wait for the ITIN to file the state return and No that is not a problem since you will not owe.
