I don't have Marketplace Insurance, but the IRS thinks I do!

I tried to e-file my return today through TurboTax and the IRS rejected it, saying, "F8962-070 - The e-File database indicates that Form 8962 or a binary attachment with description containing "ACA Explanation" must be present in the return." I cannot fill out a Form 8962, because I (and my dependents) don't have a Form 1095-A, because we don't have insurance through the Marketplace. In fact, we have Form 1095-B (I have private insurance and my dependents have Medicaid). We've NEVER had Marketplace insurance, never had Form 1095-A, and never had to fill out a Form 8962. But now the IRS thinks we do and won't accept my return without the forms. *pulling hair out*

So, I called the Marketplace, and they are going to send me a letter stating my family does not have Marketplace insurance, therefore, we do not have Form 1095-A and therefore cannot fill out Form 8962. I know I can then share that letter with the IRS, but is there a way to override the rejection I am getting when e-filing through TurboTax? Or am I going to have to paper/mail file my return? Do I print out all the forms from TurboTax and mail those to the IRS? And I guess I'll have to request an extension because there's no way all of this will be resolved by April 15.

Yes, you may still be able to e-file your return. Please visit the Help Article below for steps on how to fix this e-file rejection. View the section What if I wasn’t covered at all in 2021 through the Marketplace?

Thank you for the link! I tried the first workaround and created a "dummy" 1095-A and then deleted it from my return. Then I e-filed and it was immediately rejected again! I'm leery of trying the second workaround of entering $1 on the 1095-A and e-filing with an incorrect form in my return. This will result in a CP2000 Notice from the IRS and just further delay my refund.

Same thing is happening to me this year. I am just curious how did handle this? Did you have to do mail in papers?

You should not have to mail your tax return.  Try the following steps to remove the 1095-A from your return.

 

  1. Open your TurboTax return 
  2. Go to DEDUCTION & CREDITS > Scroll to Medical > Select Affordable Care Act > update and select No, I did not receive Form 1095-A
  3. select Continue to follow and further TurboTax instructions
    1. You can also Search (upper right) > type 1095a > click the Jump to.. link or Click 'See more' and follow the instructions

A second option is to delete the form - click the link for your TurboTax return.

You'll need to delete this form 1095-A. 

  • If you're using TurboTax Online software and need to delete a form, click here.
  • If you're using TurboTax Desktop software and need to delete a form, click here.

Once completed finish and file.

I did all these things and it still rejected. I have never had marketplace insurance, ever.

You should first confirm that you are not enrolled in the Marketplace, Then we can clear the 1095-A.

 

  • You can use the phone number by state at The Health Insurance Marketplace.
  • The list is half way down on the page.
  • Once you've confirmed that there is no 1095-A coming: You can clear a 1095-A in TurboTax,

 

To clear a 1095-A in TurboTax is a two step process.

 

  1. Select Tax Tools Note: you may have to minimize Federal and State to see it.
  2. On the drop-down select Tools
  3. There will be 4 green boxes
  4. Select Topics Search
  5. Type 1095-A
  6. The question will come up Did you receive Form 1095-A for your health insurance plan?
  7. Answer Yes
  8. Continue to the form
  9. Delete it using the trash can
  10. Repeat the process
  11. When you get to Did you receive Form 1095-A for your health insurance plan?
  12. Answer No
