No, I do not believe there is a software issue regarding this as none have been reported.  Before you do anything else, check the "My Info" section in the federal section of your entries to make sure there is nothing there about a spouse.  This could just be a simple case of an import error from Federal to State.  My suggestion is after checking the federal "My Info" section to then follow the steps to go over New York State again ... the screen will look similar to below:

If the problem in question does not solve itself through various questions and answers you should consider deleting the state and starting the state return again.

It is very easy to delete and start over at the state level provided you did not have many additions/subtractions and such to enter.

Please ignore the nonresident status.  Just happened to be there on my end.

Hi,

Sorry I didn't reply sooner.  I inadvertenly replied to the email i received containing your response.  The only thing that worked was your suggestion to delete my state return and reimport from the Federal.  Not sure what was wrong with my orginal import, because the data was the same.  Only thing missing was that annoying error.  Thanks for your help!!!
