I am the legal guardian of my spouse who is disabled can I claim him as my dependent?

You don't claim him as a dependent on your tax return.  Instead, you will file a joint return with your spouse which doubles the standard deduction for you (essentially doubling the amount of income you can make before you are taxed on any of it. 

As your spouse's legal guardian, you can sign the return on his behalf.
